Terms of Service

Effective date: October 21, 2026

Please read these Terms carefully before using shahisoftware.com or ordering any ShahiSoftware product or service. They explain what you can expect from us, what we expect from you, and how disputes are handled.

1. Agreement to These Terms

These Terms of Service (“Terms”) form a legal agreement between you and ShahiSoftware (“ShahiSoftware”, “we”, “us” or “our”), a company of the Global Elite Concern group. They govern your access to and use of the website at shahisoftware.com (the “Website”) and any products, applications, licences, subscriptions or services we provide (together, the “Services”). By using the Website or ordering a Service, you agree to these Terms. If you do not agree, do not use the Website or the Services.

2. Our Products and Services

ShahiSoftware offers software products, managed services and custom development, including:

  • WordPress plugins and licences, such as ShahiTranslate Pro, ShahiDocs Manager, ShahiPages Builder and ShahiSupport Hub;
  • hosted software-as-a-service (SaaS) platforms, such as ShahiVac, Shahi CuraNova, Shahi IMS and FortisQuantex;
  • mobile and web applications, such as HeartOS and GlobalFoodClub;
  • custom web and mobile development, IT consulting, cyber security, backup and recovery services;
  • AI-assisted features within some of the above.

We may add, change or retire Services at any time. Product descriptions on the Website are for information only and do not form part of a contract. The contract for a particular Service is formed when we accept your order or sign a written proposal, order form or statement of work (“Order”). If an Order conflicts with these Terms, the Order applies to that Service.

3. Accounts and Website Use

Some Services require an account or a support ticket. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at support@shahisoftware.com if you suspect unauthorised use. You must provide accurate information when you create an account or contact us.

4. Licences and Subscriptions

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Services for your internal business or personal purposes, for the number of sites, users, agents or other units set out in your Order.

  • You may not sub-license, resell, rent, or make the Services available to third parties, except as your Order expressly allows (for example, white-label or client-site deployments).
  • Licence fees for annual plans are charged in advance. Monthly plans renew automatically until cancelled.
  • Licences for a fixed number of sites apply only to those sites. Additional sites require an upgrade.
  • Subscriptions purchased through the Apple App Store or Google Play are subject to those stores’ own terms and refund rules.

5. Intellectual Property

The Website, the Services, our software, code, designs, trademarks (including the ShahiSoftware and product names and logos) and documentation are owned by ShahiSoftware or our licensors. Except for the limited rights granted above, nothing in these Terms transfers any intellectual property to you.

You keep ownership of content, data and materials you provide to us (“Your Content”). You grant us a limited licence to host, process and display Your Content only as needed to provide the Services to you. If you send us suggestions or feedback, we may use them without obligation to you.

6. Acceptable Use

You agree not to:

  • use the Website or Services for any unlawful purpose or in breach of any third party’s rights;
  • attempt to gain unauthorised access to any system, account, data or network;
  • reverse engineer, decompile, copy, modify or create derivative works of our software, except where the law expressly allows it;
  • interfere with or disrupt the Website or Services, including by introducing malicious code, overloading systems or running automated scraping that degrades performance;
  • remove or obscure proprietary notices, or misrepresent your relationship with ShahiSoftware;
  • upload content that is unlawful, infringing, defamatory, harmful or that you do not have the right to share.

We may suspend or restrict access where we reasonably believe these rules have been breached.

7. Third-Party Services and Links

The Website and Services may link to or rely on third-party services, including our booking provider, social media platforms, product websites operated by affiliated companies, app stores, hosting and payment providers. We do not control these services and are not responsible for their content, availability or practices. Your use of them is at your own risk and is governed by their own terms.

8. AI-Assisted Features

Some Services include features that generate or recommend content using artificial intelligence, such as summaries, translations, recommendations, document analysis or support routing. AI outputs can be inaccurate, incomplete or out of date. You are responsible for reviewing AI outputs before relying on them, particularly where they affect legal, financial, medical or safety decisions.

9. Health, Wellbeing and Regulated Use

HeartOS provides reflections, spiritual guidance and personal development content. GlobalFoodClub provides dietary and nutrition information. Shahi CuraNova, ShahiVac and related clinical products are clinical workflow and decision-support tools. None of these Services is a substitute for professional medical, psychological, nutritional or religious advice, diagnosis or treatment. In an emergency, contact your local emergency services.

If you use any Service in a regulated setting (for example, as part of clinical care, as a medical device, or where health or patient data is involved), you are responsible for confirming that your use complies with applicable regulations, and for obtaining any required clinical sign-off, approvals or agreements before deployment.

10. Fees and Payment

Prices are shown in US dollars or pounds sterling as stated on the relevant page or Order, and exclude VAT or other applicable taxes unless stated otherwise. Where VAT applies, it will be added at the rate in force. We may change prices for future renewals with at least 30 days’ notice.

Invoices are payable within the period stated on the invoice, usually 14 days. If you do not pay on time, we may suspend the affected Services after reasonable notice, and we may charge interest on overdue amounts as permitted by law.

11. Suspension and Termination

You may stop using the Services at any time and cancel subscriptions through the relevant plan settings or by contacting us. Cancellation takes effect at the end of the current billing period unless the Order says otherwise. Refunds are governed by our Refund Policy.

We may suspend or terminate your access immediately if you breach these Terms, if you fail to pay, or if we are required to do so by law. On termination, your licence ends and you must stop using the Services. Clauses that by their nature should survive termination will continue to apply, including those on intellectual property, liability, confidentiality and governing law.

12. Warranties and Disclaimers

We will provide the Services with reasonable care and skill and in line with the Order. Except as expressly stated in an Order or required by law, the Website and the Services are provided “as is” and “as available”, and we do not warrant that they will be uninterrupted, error-free or meet every requirement. We do not guarantee any particular result from using the Services, such as sales, search rankings, clinical outcomes or health improvements.

13. Limitation of Liability

To the fullest extent permitted by law:

  • we are not liable for indirect, consequential, special or punitive losses, or for loss of profit, revenue, goodwill, data or business opportunity;
  • our total liability arising out of or relating to any Service or Order is limited to the fees you paid to us for that Service in the 12 months before the event giving rise to the claim; and
  • nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited by law.

If you are a consumer, your statutory rights are not affected by these Terms.

14. Indemnity

If you are a business customer, you will indemnify us against reasonable losses, damages and costs that arise from claims by third parties caused by Your Content or by your breach of these Terms or of applicable law.

15. Confidentiality

Each party will keep confidential any non-public information it receives from the other in connection with an Order, and will use it only to perform that Order, except where disclosure is required by law or the information is already public or independently developed. This obligation continues for three years after the end of the relevant Order.

16. Privacy and Data Protection

Our handling of personal information is described in our Privacy Policy. Where we process personal data on behalf of a client, we do so under a written data processing agreement.

17. Changes to These Terms

We may update these Terms from time to time. The effective date at the top of this page shows when they were last revised. Continued use of the Website or Services after an update means you accept the revised Terms. For Services under an existing Order, changes that materially reduce your rights will apply only at renewal or with at least 30 days’ notice.

18. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that a consumer may bring proceedings in the courts of their country of residence where the law requires it. Before starting legal proceedings, the parties agree to try in good faith to resolve disputes by discussion.

19. General

These Terms, together with any Order and our Privacy Policy and Refund Policy, form the entire agreement between you and us about the Services. If any provision is found unenforceable, the remaining provisions will continue in full force. A failure or delay in enforcing a right is not a waiver of that right. You may not assign these Terms without our written consent. We may assign them to a successor of our business.
